1. Acceptance of Terms
By accessing the website at plexa-one.com or engaging PLEXA Global Agency for digital product design, web application development, or mobile engineering services, you agree to be bound by these Terms of Service and all applicable laws and regulations in England and Wales.
2. Professional Services & Deliverables
PLEXA provides specialized digital product engineering including bespoke 3D WebGL websites, Next.js web applications, native iOS & Android applications, and enterprise cloud architecture. Specific project timelines, milestones, deliverables, and payment terms are formally defined in bilateral Master Services Agreements (MSAs) or Statements of Work (SOWs).
3. Intellectual Property Rights
Upon receipt of full payment for agreed milestones, full ownership of custom client codebases, design assets, and production deliverables transfers to the client as stipulated in the project SOW. PLEXA retains ownership of proprietary agency scaffolding, generic boilerplates, and pre-existing core engineering modules.
4. Performance & SLA Guarantees
We engineer all digital solutions to adhere to industry-leading technical standards, targeting 98+ Core Web Vitals, 60fps rendering pipelines, and sub-second asset delivery over global CDNs. Production hosting managed by PLEXA is backed by our 99.99% infrastructure uptime service level agreement.
5. Limitation of Liability
To the maximum extent permitted by applicable law, PLEXA shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our digital services, beyond the total fees paid under the applicable project agreement.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in London, United Kingdom.
